This Seller Agreement (the “Agreement”) sets out the terms on which you (“Seller”, “you”, “your”) may use the Aussie Card Traders marketplace (the “Site”) to list and sell cards and related products and services to buyers (“Buyers”). The Site is operated by Aussie Card Traders (“Aussie Card Traders”, “we”, “us”, “our”).

By registering an account, creating a Listing, or otherwise using the Site as a Seller, you agree to be bound by this Agreement, our Privacy Policy, and any other policies posted on the Site.

If you do not agree with any part of this Agreement, you must not register as a Seller or use the Site to list Products.


1. Definitions and Interpretation

1.1. “Listing” means your published offer of a Product on the Site, including descriptions, images, price, condition, shipping terms and return policies.
1.2. “Product” means any card, collectible, merchandise, service or other goods you offer for sale via the Site.
1.3. “Order” means a Buyer’s accepted purchase of a Product through the Site.
1.4. “Platform Services” means the services provided by Aussie Card Traders to facilitate listings, payments, messaging, dispute handling and related marketplace features.
1.5. Headings are for convenience only. “Includes” and “including” are non-exhaustive.


2. Relationship and Scope

2.1. Aussie Card Traders operates an online marketplace platform only. You are the seller of record for all Products you list unless Aussie Card Traders expressly states otherwise. When a Buyer purchases a Product from you, a legally binding contract for sale is formed directly between you and that Buyer.
2.2. Aussie Card Traders is not a party to the contract between you and the Buyer and does not assume your obligations under consumer or other applicable laws.
2.3. Aussie Card Traders may, at its discretion, provide Platform Services such as payment processing, escrow, refunds or dispute handling, but such involvement does not relieve you of your legal obligations as a Seller.


3. Acceptance; Eligibility

3.1. To sell on the Site you must be at least 18 years old, have the legal capacity to enter into binding contracts, and be legally permitted to sell the Products you list under Australian and Queensland law.
3.2. By creating a Seller account, you represent that all information you provide is true, accurate, current and complete, and that you will promptly update it as required.
3.3. You warrant that you are acting either as a private seller or business seller as disclosed in your account and Listings.


4. Listings, Pricing and Orders

4.1. You are responsible for ensuring that all Listings are accurate, complete and not misleading, including descriptions of condition, authenticity, pricing, shipping costs and delivery timeframes.
4.2. Prices must be stated in Australian Dollars and include GST where applicable, unless clearly stated otherwise in compliance with Australian law.
4.3. By accepting an Order, you agree to supply the Product exactly as described in the Listing and within the stated handling and shipping timeframes.
4.4. Aussie Card Traders may remove or suspend Listings that are inaccurate, misleading, non-compliant or suspected of fraud.


5. Payments, Fees and Settlement

5.1. Where Aussie Card Traders acts as payment intermediary, Buyer payments may be held, processed or released in accordance with our Payment Policy.
5.2. You authorise Aussie Card Traders to deduct applicable fees, commissions, refunds, chargebacks or adjustments from amounts payable to you.
5.3. You are responsible for all taxes, duties and reporting obligations arising from your sales unless expressly stated otherwise.


6. Consumer Guarantees and Legal Obligations

6.1. You acknowledge that the Australian Consumer Law (ACL) imposes non-excludable consumer guarantees on goods and services sold to consumers in Australia.
6.2. You must not represent that Products are sold “as is”, “no refunds” or otherwise in a manner that excludes or limits statutory consumer rights where such exclusion is unlawful.
6.3. Any return or refund policies you publish must be consistent with the ACL and Queensland consumer protection legislation.


7. Returns, Refunds and Faulty Goods

7.1. You are responsible for handling returns, refunds and remedies for faulty, damaged, misdescribed or non-compliant Products in accordance with consumer law.
7.2. Where a dispute arises and you fail to respond or resolve the issue, Aussie Card Traders may, at its discretion, facilitate a refund or other remedy and recover the amount from you.
7.3. Change-of-mind returns may be offered at your discretion, but must be clearly stated in your Listing and cannot override statutory rights.


8. Shipping, Delivery and Risk

8.1. You are responsible for packaging, shipping and dispatching Products in accordance with your Listing terms and within the stated handling time.
8.2. Risk in the Product passes to the Buyer in accordance with applicable law and your stated delivery terms, subject to consumer guarantees.
8.3. You must not knowingly provide false or misleading tracking, dispatch or delivery information.


9. Seller Conduct and Obligations

9.1. You must:
(a) act honestly and in good faith in all dealings;
(b) sell only Products you are legally entitled to sell;
(c) ensure Products are authentic and not counterfeit;
(d) comply with all Site policies, including prohibited items rules;
(e) not attempt to circumvent fees, payments or dispute processes.

9.2. You must respond to Buyer communications and disputes promptly and professionally.


10. Prohibited Products and Activities

10.1. You must not list or sell any Product that is illegal, counterfeit, stolen, misleadingly described, or prohibited under Site policies or Australian law.
10.2. Aussie Card Traders may suspend or terminate Listings or accounts suspected of violating these requirements without prior notice.


11. Communication, Reviews and Feedback

11.1. You agree to use Site messaging tools for communications relating to Orders.
11.2. You must not attempt to manipulate, coerce or retaliate against Buyers regarding reviews or feedback.
11.3. Aussie Card Traders may remove reviews or content that breaches Site policies.


12. Disputes and Dispute Resolution

12.1. If you have a dispute with a Buyer, you must attempt to resolve it with the Buyer in good faith. If unresolved you may escalate to Aussie Card Traders using the Site’s dispute process. Aussie Card Traders may require supporting evidence (photos, tracking numbers, messages) and will apply thr dispute procedure described in our Dispute Resolution Process.
12.2. If escalated, you must cooperate fully with Aussie Card Traders’ dispute process and provide requested evidence.
12.3. Aussie Card Traders’ determination under its dispute process is final for platform purposes and may result in refunds, account action or other remedies.
12.4. Any disputes or complaints are to be registered with Aussie Card Traders on their Report an Issue page. All other methods will be ignored.


13. Liability and Indemnity

13.1. To the extent permitted by law, you indemnify Aussie Card Traders against losses, claims or liabilities arising from your Listings, Products, conduct or breach of this Agreement.
13.2. Aussie Card Traders is not liable for your acts or omissions, nor for indirect or consequential losses except where prohibited by law.


14. Intellectual Property

14.1. All Site intellectual property remains the property of Aussie Card Traders or its licensors.
14.2. By uploading content (including images and descriptions), you grant Aussie Card Traders a non-exclusive, royalty-free, worldwide licence to use that content for operating and promoting the Site.


15. Privacy and Data

15.1. You must handle Buyer personal information solely for fulfilling Orders and in compliance with privacy laws.
15.2. Personal information is otherwise handled in accordance with our Privacy Policy.


16. Suspension, Termination and Account Closure

16.1. Aussie Card Traders may suspend or terminate your Seller account for breach, suspected fraud, repeated disputes, legal risk, or at our discretion.
16.2. Outstanding obligations, refunds or liabilities survive termination.


17. Changes to this Agreement

17.1. This Agreement may be amended by posting updated terms on the Site. Continued use of the Site constitutes acceptance of the revised Agreement.


18. Notices

18.1. Notices may be provided via the Site or email. Notices to Aussie Card Traders must be sent to https://cardlotz.com/report-an-issue.


19. Governing Law and Jurisdiction

19.1. This Agreement is governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.


20. General

20.1. If any provision is invalid, the remaining provisions remain in effect.
20.2. This Agreement, together with the Privacy Policy, Buyer Agreement and other incorporated policies, constitutes the entire agreement between you and Aussie Card Traders.


21. Help and Complaints

21.1. Seller support and disputes must be lodged via the Report an Issue page on the Site. External complaints may be made to the Queensland Office of Fair Trading or ACCC where applicable.


22. Acknowledgement

By listing Products or using the Site as a Seller, you acknowledge that you have read, understood and agree to be bound by this Agreement and that you have had the opportunity to obtain independent legal advice.
