These Terms and Conditions of Use (“Terms”) govern your access to and use of the website https://cardlotz.com (“Website”), and any services provided by Aussie Card Traders (“Aussie Card Traders”, “we”, “us”, “our”). By accessing or using the Website in any manner (including browsing, registering, posting or transacting), you agree to be bound by these Terms.

2. Acceptance of Terms
2.1 You represent and warrant that you are of legal age to form a binding contract (at least 18 years old).
2.2 These Terms constitute a legally binding agreement between you and Aussie Card Traders.

- Member: A registered user on the Website.

5. Registration and Accounts

5.2 You are responsible for all activity under your account and must notify us of any unauthorized use.
6. Use of the Website

7. Marketplace Transactions
7.1 The Website facilitates the listing, purchasing, trading, and selling of collectible cards between Members (“Transactions”). We do not take title to items.
7.2 All Transactions are strictly between buyers and sellers. Aussie Card Traders acts as a technology service provider only.
7.3 We may provide payment processing services through third‑party payment processors.
8. Fees and Payments
8.1 Fees: Marketplace fees (listing fees, success fees, commissions, service fees) are set forth on our Fees page and may change from time to time.
8.2 Payment Terms: You agree to pay all applicable fees. All payments are in Australian Dollars (AUD).
8.3 Taxes: You are responsible for all applicable taxes, duties and levies.
9. Listings and Content
9.1 Members represent that all listings and content they upload are accurate, lawful and in line with our Seller Agreement.
9.2 You grant us a worldwide, non‑exclusive, royalty‑free licence to use, reproduce, modify, publish and display your Content for operating the Marketplace.
10. Intellectual Property
10.1 All Website content (design, text, graphics, audio, code) is protected by copyright, trademark and other intellectual property laws.
10.2 You must not copy, distribute, perform or create derivative works without our written consent.
11. User Reviews and Feedback
11.1 Users may post reviews, feedback and ratings. You agree not to post defamatory, discriminatory, unlawful or abusive content.
11.2 We may remove or modify content at our discretion.
12. Privacy and Personal Information
12.1 Our use of your personal information is governed by our Privacy Policy available on the Website.
12.2 By using the Website, you consent to such use and disclosure of your information.
13. Dispute Resolution Between Members
13.1 Except for Claims related to intellectual property or Australian Consumer Law rights, Members agree to resolve disputes through binding arbitration in Brisbane, Queensland, under the Commercial Arbitration Act 2013 (Qld).
13.2 You waive rights to class actions and jury trials for such disputes.
14. Intellectual Property Infringement Claims
14.1 If you believe content infringes your intellectual property rights, provide us with a written notice including:
(a) Identification of the work claimed to be infringed;
(b) Your contact information;
(c) A statement of good‑faith belief.
14.2 We will respond in accordance with applicable law.

15. Termination

17. Liability Limitation
To the extent permitted under applicable law, Aussie Card Traders and its affiliates, officers, directors and employees are not liable for indirect, incidental, punitive, special or consequential damages arising out of your use of the Website. Our total liability is limited to the amount you paid in the prior 12 months.
18. Indemnity
You agree to indemnify and hold harmless Aussie Card Traders from any claims, losses, damages, liabilities, costs and expenses (including legal fees) arising out of:
(a) Your breach of these Terms;
(b) Your use of the Website;
(c) Your Listings or conduct on the Marketplace.
19. Governing Law
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of Queensland.
20. General
20.1 Force Majeure: We are not liable for delays caused by events beyond our control.
20.2 Severability: If any provision is held invalid, the remainder of these Terms remain in effect.
20.3 Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us relating to the subject matter.
