Terms and Conditions (Queensland)
1. Promoter
The promoter of this giveaway is Aussie Card Traders Pty Ltd (“Aussie Card Traders”, “we”, “us”, “our”), the operator of the online marketplace available at https://cardlotz.com, Queensland, Australia.
2. Relationship to Marketplace Terms
2.1 These Giveaway Terms and Conditions supplement and form part of the following documents (together, the “Platform Terms”):
- Aussie Card Traders Website Terms & Conditions;
- Buyer Agreement;
- Seller Agreement;
- Payment Policy; and
- Privacy Policy.
2.2 Participation in the Competition constitutes confirmation that you have read, understood, and agreed to be bound by all Platform Terms, as updated from time to time.
2.3 In the event of any inconsistency between these Competition Terms and the Platform Terms, these Competition Terms prevail solely in respect of the Giveaway, to the extent of the inconsistency.
3. Eligibility
3.1 Entry is open to Australian residents aged 16 years or over who:
- Hold a valid and active Aussie Card Traders account; and
- Are not suspended, restricted, or under investigation under the Platform Terms.
3.2 Eligibility is restricted to verified accounts only, as specified in the Competition description.
3.3 Any account found to be in breach of the Platform Terms at any time during the Competition Period may be excluded or disqualified.
3.4 Business Accounts Excluded
Participation in this Competition is limited to personal Aussie Card Traders accounts. Accounts registered as businesses, commercial entities, or storefronts are not eligible to earn points or win prizes. Any points accrued on business accounts will be void, and such accounts may be disqualified from the Competition.
3.5 Excluded Persons (Family and Associates)
Employees, contractors, officers, and representatives of Aussie Card Traders, and their immediate family members and close personal associates (including friends), are not eligible to participate in the Competition, earn points, or win any Prize. Any points accrued by such persons will be void, and the Promoter reserves the right to disqualify any ineligible participant at its discretion.
For the purposes of this clause, immediate family members include a spouse, de facto partner, parent, child, sibling, or any person residing in the same household.
4. Competition Period
4.1 The Competition commences is run quarterly for the duration of that quarter (“Competition Period”).
4.2 Points accrued outside the Competition Period will not be counted.
5. How Points Are Earned
5.1 Points may be earned by completing eligible actions on the Aussie Card Traders platform (“Eligible Actions”), as determined and published by Aussie Card Traders.
5.2 Eligible Actions may include marketplace participation, account activity, promotional engagement, or other lawful actions permitted under the Platform Terms.
Current Actions are:
- 1 Point for registering to Aussie Card Traders (once off)
- 2 Points for listing a product for sale – 2 each listing
- 3 Points for purchasing a product – 3 each purchase
- 5 Points for getting Verified – 1 time (once off)
- 1 Point for sharing on any social network – 1 time (Maximum 20 shares/mth)
5.3 Any activity that would constitute a breach of the Platform Terms cannot generate points, even if technically recorded.
5.4 Points:
- Have no monetary value;
- Are not a form of credit, balance, or stored value;
- Are non-transferable and non-redeemable outside the Competition.
5.5 Points Expiry
All points earned in the Competition will expire at the end of each quarter (every three months) and will not carry over into subsequent periods. Only points earned within the current quarter will count toward determining the Winner for that period.
6. Points Tracking, Enforcement, and Integrity
6.1 Points are tracked using Aussie Card Traders’ internal systems. Our records are final and binding.
6.2 Aussie Card Traders may adjust, revoke, or invalidate points where they are earned through:
- Prohibited conduct under the Platform Terms;
- Fraud, manipulation, automation, or abuse;
- Transactions reversed, cancelled, refunded, or subject to dispute.
6.3 Enforcement actions taken under the Platform Terms (including suspension or termination) automatically apply to Competition participation without further notice.
6.4 Points expire every quarter
7. Winner Determination
7.1 This Competition is conducted as a points-based competition, where participants accrue points by completing eligible actions on the Aussie Card Traders platform, including registering, verifying their account, listing items, buying and selling items, and sharing content to social media. Points are awarded only for lawful, compliant, and legitimate actions, and the participant with the highest verified total points at the end of the Competition Period will be declared the Winner.
7.2 The participant with the highest verified point total at the end of the Competition Period will be declared the winner (“Winner”).
7.3 In the event of a tie, Aussie Card Traders may determine the Winner by:
- The participant who first achieved the highest score; or
- The participant that acheived the most sales consistent with the Platform Terms.
7.4 All determinations are final and not subject to appeal.
8. Prize
8.1 The prizes for this Competition (“Prize” or “Prizes”) may vary in type, quantity, and value. The estimated value of each Prize will be specified in the Competition announcement or on the Aussie Card Traders website at the time of award.
8.2 The Prize is not transferable, exchangeable, or redeemable for cash, except where required by law.
8.3 Prize fulfilment is conditional upon the Winner remaining compliant with the Platform Terms at the time of award.
9. Winner Notification and Claim
9.1 The Winner will be notified via their registered Aussie Card Traders account or email within 7 business days of the Competition ending.
9.2 Failure to claim the Prize within 7 days after notification may result in forfeiture and reallocation to the next eligible participant.
10. Queensland Trade Promotion Compliance
10.1 This Competition is conducted in accordance with Queensland law and the requirements of the Office of Liquor and Gaming Regulation (OLGR).
10.2 Because this Competition is based on the accrual of points through platform participation rather than chance, a trade promotion permit is not required under Queensland law.
11. Disqualification
Without limiting any other rights, Aussie Card Traders may disqualify any participant who:
- Breaches these Competition Terms or any Platform Terms;
- Engages in misleading, deceptive, or fraudulent conduct;
- Attempts to exploit platform mechanics, security, verification systems, or payment processes.
12. Limitation of Liability
Nothing in these Terms excludes rights under the Australian Consumer Law.
Subject to non-excludable rights, Aussie Card Traders is not liable for losses arising from participation in the Competition, system errors, enforcement actions, or Prize use.
13. Privacy
13.1 Personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Aussie Card Traders Privacy Policy.
13.2 By participating, you consent to the use of your name, username, or store name for Competition administration and Winner announcements.
14. Modification, Suspension, and Termination
Aussie Card Traders may modify, suspend, or terminate the Competition or these Terms where reasonably necessary to:
- Comply with law;
- Align with Platform Terms; or
- Protect marketplace integrity.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia, and participants submit to the exclusive jurisdiction of Queensland courts.
