Aussie Card Traders is an online marketplace where independent sellers list and sell trading cards and accessories. The platform facilitates listings, payments, messaging, dispute resolution, and related marketplace services. When a buyer purchases an item, the contract for sale is directly between the buyer and the seller. Aussie Card Traders operates as the marketplace facilitator (admin).

Q: Who is responsible for the contract of sale?
Each sale creates a legally binding contract directly between the buyer and the seller. The platform does not become a party to that contract unless explicitly stated.


2. Account Requirements

Q: What are eligibility requirements?
You must be at least 18 years old and legally capable of entering a binding contract or have the permission of your parent/guardian. Sellers must lawfully be able to sell the items they list.


3. Buying Items

Q: How do I buy cards?
Browse listings, add items to your cart, and complete checkout using supported payment methods (credit/debit cards or Paypal). Payments are subject to verification and authorisation.

Q: What happens when I purchase from multiple sellers?
Orders may include products from different sellers. Each seller fulfils and ships their portion of the order independently.

Q: What protections do buyers have under Australian law?
Buyers may have rights under the Australian Consumer Law (ACL) where the seller is acting in the course of a business. Where a seller is a private individual not operating a business, certain statutory consumer guarantees may not apply. Buyers should review the seller’s profile and listing details carefully before purchasing. Nothing in the marketplace terms limits any non-excludable rights that apply by law.


4. Selling & Seller Obligations

Q: What must a seller do when listing products?
Sellers are responsible for ensuring that all listings are accurate, complete, and not misleading, including condition, authenticity, pricing, shipping costs, and handling times.

Q: What legal responsibilities do sellers have?
Sellers must comply with all applicable laws. Sellers operating in the course of a business are required to comply with the Australian Consumer Law, including statutory consumer guarantees, which cannot be excluded. Sellers who are private individuals not acting as a business may not be subject to the same statutory guarantees, however they must still ensure that listings are accurate, not misleading, and comply with marketplace rules and general law.

Q: What happens if a seller does not fulfil an order?
If a seller fails to fulfil an order or resolve a dispute, the platform may intervene to facilitate refunds or remedies and recover amounts from the seller where appropriate.


5. Payments, Fees, and Payouts

Q: What payment methods are accepted?
Aussie Card Traders accepts:

  • Credit/Debit Cards (e.g., Visa, MasterCard, AmEx)
  • Digital Wallets (Apple Pay, Google Pay where enabled)
  • Paypal

Q: Are seller fees and commissions charged?
Yes. The marketplace may charge:

  • Membership fees for premium features
  • Transaction/commission fees on completed sales
  • Payment processing fees
    All fees excluding GST are disclosed and deducted in accordance with the Payment Policy.

Q: When are seller earnings paid?
Funds are remitted to sellers after cleared payment and any applicable holds or verification checks. Sellers will need to complete identity verification before payouts.

Q: Do sellers face chargeback liabilities?
Yes. If buyers initiate chargebacks, sellers may be liable for the amounts and related fees if the dispute is resolved against them.


6. Shipping & Delivery

Q: Who organises shipping?
Each seller is responsible for packaging, shipping, and delivery of their products as described in their listing.

Q: Who bears the risk and title of goods?
Risk and title transfer are governed by seller-listed terms and applicable law. Generally, risk passes upon delivery while title passes upon payment as stated in a seller’s listing.


7. Refunds, Returns & Chargebacks

Q: What do I do if an item is faulty or misdescribed?
Contact the seller through the marketplace messaging system first. If unresolved, escalate through the platform’s dispute process. Aussie Card Traders may facilitate refunds or other remedies consistent with consumer law.

Q: Can sellers exclude refunds for change-of-mind?
Sellers may state a change-of-mind policy, but that cannot override statutory consumer rights where those rights apply.

Q: How are chargebacks handled?
Chargebacks initiated through a card issuer are managed in cooperation with payment providers. Sellers may incur liability if a chargeback is upheld against them.


8. Dispute Resolution

Q: How do I raise a dispute?
Attempt to resolve directly with the other party first via the platform’s messaging system. If unresolved, submit a dispute via Help & Support > Report an Issue with detailed evidence (photos, tracking, messages).

Q: What timeframes apply to the dispute process?

  • Acknowledgement: within 2 business days after submission
  • Support review: within 5 business days
  • Additional evidence response: up to 7 calendar days
  • Final decision based on complete evidence: within 12 business days
    Returns (if agreed) must be completed within 14 calendar days.

Q: Are decisions final?
Platform dispute decisions are final and binding for marketplace purposes. Users may still pursue external remedies under consumer law after a decision is issued.

Q: What happens if a user fails to comply with a dispute decision?
Non-compliance can lead to sanctions including account suspension, withholding of funds, or other restrictions.


9. Ratings & Feedback

Q: How does the review system work?
Buyers may leave reviews after a successful purchase. Reviews must be honest and accurate and should not be defamatory. Aussie Card Traders may remove reviews that violate policy.


10. Security & Marketplace Integrity

Q: What security measures are in place?
Payments comply with robust standards and are processed via third-party payment gateways. Sensitive payment details are not stored by the platform. Transactions are monitored for fraud.

Q: Can sellers be suspended?
Yes. Sellers may be suspended or removed for policy violations, unresolved disputes, fraudulent activity, or legal risk.
