This Buyers Agreement (the “Agreement”) sets out the terms on which you (“Buyer”, “you”, “your”) may use the Aussie Card Traders marketplace (the “Site”) to purchase cards and related products and services from third-party sellers listed on the Site (each a “Seller”). The Site is operated by Aussie Card Traders (“Aussie Card Traders”, “we”, “us”, “our”). By registering an account, placing an order, or otherwise using the Site you agree to be bound by this Agreement and our Privacy Policy and any other policies posted on the Site.
If you do not agree with any part of this Agreement, do not register or use the Site.
1. Definitions and Interpretation
1.1. “Listing” means a Seller’s published offer of a Product (including photos, descriptions, price and shipping terms) on the Site.
1.2. “Product” means any card, collectible, merchandise, service or other goods offered for sale via the Site.
1.3. “Order” means a Buyer’s accepted request to purchase a Product via the Site.
1.4. “Platform Services” means the services Aussie Card Traders provides to facilitate marketplace listings, payments, messaging, dispute handling and related features.
1.5. Headings are for convenience only. “Includes” and “including” are non-exhaustive.
2. Relationship and Scope
2.1. Aussie Card Traders provides an online marketplace platform that allows Sellers to list Products and Buyers to purchase those Products. Aussie Card Traders is not the seller of Products listed by third-party Sellers unless we expressly state otherwise. When you buy a Product listed by a Seller, a contract for sale is formed between you and that Seller.
2.2. Notwithstanding clause 2.1, Aussie Card Traders may, in its discretion, provide support, hold payments in escrow, operate refunds or otherwise facilitate transactions; however, our involvement does not replace the Seller’s legal obligations under consumer law. 3. Acceptance; Eligibility
3.1. To use the Site you must be at least 18 years old, have the legal capacity to enter contracts, and be acting for personal, household or domestic purposes (unless the Listing states it is available for business purchasers).
3.2. By creating an account and placing an Order, you confirm that all registration information is true, current and complete and you will maintain and promptly update your information.
4. Orders, Pricing and Payment
4.1. Listings show the price a Seller requires for the Product. Prices are quoted in Australian Dollars and include GST where applicable (unless stated otherwise). Shipping, handling, taxes, duties or other charges may be added and are specified in the Listing or at checkout.
4.2. All payments are subject to verification and acceptance by Aussie Card Traders and our third-party payment providers. We may suspend or cancel an Order where payment verification fails, a Listing is inaccurate, or prospective fraud is suspected.
4.3. Where Aussie Card Traders acts as payment intermediary, funds are held or processed in accordance with our payment policy. Aussie Card Traders may deduct fees, commissions, refunds or chargebacks in accordance with Site fee schedules.
5. Consumer Guarantees and Non-Excludable Rights
5.1. The Australian Consumer Law (ACL) provides non-excludable consumer guarantees in respect of goods and services sold to consumers in Australia (for example, that goods will be of acceptable quality, fit for a disclosed purpose and match their description). These statutory rights cannot be excluded, restricted or modified by contract. Any provision in this Agreement that seeks to limit or remove those statutory rights will be read down or will not apply to the extent prohibited by law.
5.2. Nothing in this Agreement limits your rights under the ACL or Queensland consumer-protection legislation. For specific examples and how guarantees apply to goods bought online, see official consumer guidance.
6. Returns, Refunds and Faulty Goods
6.1. If a Product is faulty, not as described, damaged in transit or does not comply with consumer guarantees, you should first contact the Seller to request a remedy (repair, replacement or refund). Where a Seller does not resolve the issue you should contact Aussie Card Traders for assistance. Aussie Card Traders may, at its discretion, facilitate refunds or other remedies.
6.2. Sellers may publish return policies for change-of-mind returns (e.g. “no returns for change of mind”), but such policies cannot override your statutory rights. Aussie Card Traders’ refund processes must not misrepresent or deny these consumer rights.
6.3. If an Order is eligible for a refund through Aussie Card Traders (for example, where the Seller is unresponsive or the Product was misrepresented), any refund will be processed to the original payment method subject to our refund policy and any applicable time frames.
7. Delivery and Risk
7.1. Unless the Listing states otherwise, risk in Products passes to you at the time the Product is delivered to the delivery address you provide. Title passes on payment to the Seller in accordance with the Seller’s Listing terms.
7.2. Delivery estimates provided by Sellers are estimates only and not binding delivery deadlines unless explicitly stated. Sellers must not knowingly provide false or misleading delivery information.
8. Buyer Obligations and Conduct
8.1. You must: (a) provide accurate contact, payment and delivery information; (b) comply with Listing requirements (e.g. eligibility or age restrictions); (c) not use the Site to misrepresent identity or to conduct fraudulent or illegal activities; (d) not attempt to circumvent Site fees, controls or dispute processes.
8.2. You must inspect received Products promptly and report any issue to the Seller and Aussie Card Traders within a reasonable time.
9. Prohibited Products and Activities
9.1. You may not buy, list for purchase, or attempt to purchase any Product prohibited by the Site rules, local law, or Listing terms (including counterfeit goods, illegal items and items restricted under Australian law). Sellers and Buyers must comply with the Site’s Prohibited Items policy. Aussie Card Traders may suspend or remove Listings or accounts suspected of violating these rules.
10. Communication, Reviews and Feedback
10.1. You agree to use Site messaging tools for communication with Sellers. Keep records of communications relating to Orders.
10.2. Reviews and feedback must be honest and accurate. Do not post defamatory, obscene or fraudulent reviews. Aussie Card Traders reserves the right to remove reviews that violate policy.
11. Disputes and Dispute Resolution Process
11.1. If you have a dispute with a Seller, you must attempt to resolve it with the Seller in good faith. If unresolved you may escalate to Aussie Card Traders using the Site’s dispute process. Aussie Card Traders may require supporting evidence (photos, tracking numbers, messages) and will apply a dispute procedure described in our Dispute Resolution Process.
11.2. If Aussie Card Traders cannot resolve the dispute, you retain any statutory remedies under the ACL and may pursue relief through the Queensland Office of Fair Trading, the ACCC, small claims courts or other available legal channels.
11.3. Any disputes or complaints are to be registered with Aussie Card Traders on their Report an Issue page. All other methods will be ignored.
12. Liability and Limitation
12.1. To the extent permitted by law, Aussie Card Traders’ liability to you in connection with the Site, this Agreement, or any Product is limited to the lesser of: (a) the price paid by you for the Product that gave rise to the claim; or (b) AUD 100. This limitation does not apply to non-excludable statutory rights under consumer law.
12.2. Aussie Card Traders is not liable for: (a) Sellers’ acts or omissions; (b) indirect, special, incidental or consequential loss (except where prohibited by law); or (c) losses arising from your failure to follow Listing instructions.
13. Intellectual Property
13.1. All Site content (brand, logos, designs, text, images and software) is owned by or licensed to Aussie Card Traders. You may not copy, reproduce, modify or distribute Site content except as necessary to use the Site in accordance with this Agreement.
13.2. By submitting content (e.g., product photos, messages, reviews) you grant Aussie Card Traders a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content for the purposes of operating and promoting the Site.
14. Privacy and Data
14.1. Personal information collected through the Site will be handled in accordance with our Privacy Policy. By using the Site you consent to the collection, use and disclosure of personal information as described in the Privacy Policy.
15. Fees, Charges and Surcharges
15.1. Aussie Card Traders may charge Buyers fees for certain features (e.g., instant payments, dispute processing). All applicable fees are displayed at checkout or in your account settings.
15.2. Any payment surcharges must be disclosed and compliant with applicable law. The ACCC has prioritised enforcement against misleading surcharging practices — Aussie Card Traders will not permit Sellers to mislead about surcharges.
16. Suspension, Termination and Account Closure
16.1. Aussie Card Traders may suspend, restrict or terminate your account and access to the Site for breach of this Agreement, suspected fraud, illegal conduct, repeated buyer disputes, or at our discretion. Termination does not affect obligations or liabilities arising before termination.
16.2. On termination, you must cease using the Site and return or destroy any confidential information received via the Site.
17. Changes to this Agreement
17.1. We may amend this Agreement by posting the revised terms on the Site and indicating the “last updated” date. Your continued use of the Site after the change constitutes acceptance of the new terms. Where changes materially disadvantage Buyers, we will use reasonable efforts to provide notice.
18. Notices
18.1. Notices to you will be provided via the Site, email, or postal address you provided. Notices to Aussie Card Traders should be sent to: [email protected] (or to our registered office address set out on the Site).
19. Governing Law and Jurisdiction
19.1. This Agreement is governed by the laws of the State of Queensland, Australia. You and Aussie Card Traders submit to the non-exclusive jurisdiction of courts sitting in Queensland. Nothing in this clause limits any consumer right you may have under the ACL or other applicable law.
20. General
20.1. If any provision is held invalid, the remaining provisions remain in full force.
20.2. This Agreement, together with the Privacy Policy, Seller Agreement and any other policies expressly incorporated by reference, constitutes the entire agreement between you and Aussie Card Traders in relation to its subject matter.
21. How to Get Help or Make a Complaint
21.1. For help with Orders, refunds or disputes contact support via the Report and Issue page of our website. If you remain unsatisfied with a Seller’s response, you can escalate through Aussie Card Traders’ dispute system or contact your consumer protection authority (e.g., Queensland Office of Fair Trading or the ACCC). 22. Acknowledgement
By placing an Order or using the Site you acknowledge that you have read, understood and agree to be bound by this Agreement and that you have had an opportunity to seek independent legal advice if you wished.
